Well, not exactly. That's what inspections are for. Any court is going to ask you if you had inspections done, and what the results of the inspections were. They'll also want to know if the inspector made recommendations, and if you followed up on them. (Have the septic tank pumped and inspected closer, etc.) Now, if the sellers LIE about the history of the house, and problems with the house, and you can PROVE that they knew there were problems and lied about them, then you MIGHT have a case. It's really difficult to prove that, though. Make sure you have a thorough inspection done. Also have any follow-up or further inspections done that are recommended by your first home inspector.

If the house is Brand New then yes............otherwise get a house inspection(Even on a Brand Newly Built House) prior to closing.

Check paperwork ...house may be sold as is.

Make your sales contract contingent on the home inspection. Attend your home inspection...it's so important. This way you can have the seller's fix anything unacceptable or get out of the contract.

If it's a brand new home, it should come with a 1 year warrantee (check the contract).

Always, always, always get an inspection. Just because a house is brand new doesn't mean there aren't issues. Our house is brand new and came with 72 code violations. Our home was never inspected and we were advised not to have an inspection as the house was brand new and a co couldn't be issued unless everything was right.

Do not trust the Town or your realtor to look out for you - do your homework - get an inspection.
