Due to the silly attorney commercials, the Lemon Laws are some of the most misunderstood ones out there.

Only a few states have Lemon Laws for used vehicles, and the one thing that is common throughout all of them is the vehicle must still be under the original manufacturer’s warranty. The laws will vary as to how many attempted fixes the dealer can have on one issue. Also, you must proceed through a ton of red tape to file a claim.

Just because a used car has an issue and isn’t running… doesn’t mean it’s a "Lemon" under the law.

*EDIT — For the "thumbs-down" fairy… if you can prove us wrong, please do so. But don’t degrade an answer just because it isn’t what you want to hear. There is no magic law.

No, it does not apply to used cars..

Lemon law only applies to new vehicles and you must prove that they can not fix it after 3 or more attempts.

Unfortunately not hun.. You bought it as is so there is not much you can do.

it was a as is no warranty

What do you think that means? Lemon laws apply only to new cars, and only in some circumstances.

See http://www.ag.ca.gov/consumers/general/lemon.php if you are interested in the law on new cars, but no, it doesn’t apply to you since you bought a vehicle used, as is, no warranty.

Generally, if a NEW car has been repaired 4 or more times for the same Defect within the Warranty Period and the Defect has not been fixed, the car qualifies as a Lemon. A vehicle that continues to have a defect that substantially impairs its use, value, or safety could be classified as a lemon. All States differ so you should consult the Lemon Law for your particular State. Note that the warranty period may or may not coincide with the Manufacturer’s Warranty. Generally lemon laws ONLY apply to the first owner, but they may continue to apply as long as the car is under the original new car warranty period.

As-is/no warranty = NO LEMON LAW. The lemon laws were never intended to cover every piece of junk on the road. Lemon laws protect the buyers of NEW vehicles from serious, recurring defects.

The Lemon law protects ALL used car buyers. Especially as-is cars.

The "tooth fairy" administers the program. So leave your request under your pillow and hope for the best.

The tooth fairy is a busy fairy and you will have to be patient.

Just think if you ever sell a used car, YOU can be responsible for life for it too !
